Introduction

JobsInRI.com is devoted to the employers and the job seekers of Rhode Island and providing them with a dynamic website on which to search for one another and connect.

As such it is our philosophy and everyday business practice that we will strive to create on our website an atmosphere of trust and credibility between employers and job seekers.

Accordingly, adherence to our Acceptable Use Policy by both our employers and our job seekers is essential to maintaining the trust and credibility of all users of the website.

Acceptable Use Terms & Conditions

This page states the Terms and Conditions for acceptable use under which you may use JobsInRI.com (the website) and post user-generated content (posting, postings).

Please read this page carefully. If you do not agree to the Terms and Conditions stated here, do not use the website. By using the website, you indicate that you agree to abide by the Terms and Conditions.

JobsInTheUS, Inc. (the Company), the sole owner/operator of the website, may revise these Terms and Conditions at any time. You should visit this page periodically to review the Terms and Conditions.

The terms "User," "Job Seeker," "Job Seekers," "Employer" and "Employers," as used herein, refer to all individuals and/or entities accessing and using the website for any reason. The terms "Employer," "Employers" apply to an individual, a company or an otherwise legally recognized entity in the state of Rhode Island that seeks to advertise itself and/or its legitimate job openings on the website. The terms "Job Seeker," "Job Seekers" apply to an individual(s) seeking information about companies and/or job openings which are advertised by an Employer on the website.

Acceptable Uses by Employers

The website may be used for lawful purposes only by our employers to serve their legitimate hiring interests by promoting their company and their jobs by means of creating a company profile and posting job openings. Employers may conduct the following activities on the website:

  • Create and maintain a company profile.
  • Post job descriptions for legitimate job openings for hire.
  • Search the job seeker resume database for hiring candidates. (requires Premier subscription)
  • Contact job seekers of interest through the inquiry system in the employer account on the website. (requires Premier subscription)
  • Accept resumes and/or contact from job seekers by way of the website's apply online feature or via other contact information on the employer's company profile and/or job posting.
  • Upload photos or logos to the employer's company profile/job posting on the website or link the employer's company profile/job posting on the website to photos or logos on the employer's own website. (requires Premier subscription)
  • Link the employer's company profile/job posting on the website to employment applications on the employer's own website or elsewhere. (requires Premier subscription)

Prohibited Uses by Employers

The Company specifically prohibits the use of the website by employers for any of the following activities:

  • Registering as an employer on the site under false pretenses.
  • Using the website for any activity other than promoting your company and advertising your job openings or other authorized business on the website.
  • Registering under false names, pseudonyms, aliases or otherwise misleading company information.
  • Posting jobs wherein the actual work for that job is performed outside of Rhode Island.
  • Posting franchise opportunities
  • Posting Pyramid schemes
  • Posting jobs that require club membership, MLM (Multi-Level Marketing) or anything that requires recruitment of other members, sub-distributors or sub-agents.
  • Business opportunities that resemble in fact or appearance any of the preceding three descriptions.
  • Distributorship or other business opportunities which require an up-front investment or periodic payment.
  • Psychic, pornographic, dating service, escort service or other similar telephone hotline jobs.
  • Accessing the job seeker database or the resume database for purposes of solicitation of any kind beyond the intended use of normal employer - job seeker contact.
  • Posting jobs under a company name not previously disclosed during the registration process. (Employers must fully and accurately list the legal name of your company at the time of registration, including subsidiaries and/or dba's under which you are registering your business. Employers may post a confidential or 'blind' ad. However, employers must use a current legal company name at the time of registration on the website.)
  • Creating multiple postings for one job in an attempt to artificially amplify a single job opening throughout the website.
  • Standard level employers are restricted from uploading or linking to photos or logos on the employer's company profile or job postings on the website or linking to employment applications on the employers own website or elsewhere. (requires Premier subscription)
  • The company profile is intended for information about the employer. Posting specific job information inside the company profile is prohibited.
  • As with all postings to the website, the Company reserves the right to remove any postings of any kind that do not conform to the requirements and spirit of this Acceptable Use Policy.
  • Unauthorized database mining

NEW Company Profile Posting Policy (July 2010)

Employers may post only one company profile per employer. Employers with more than one company profile will be contacted to consolidate multiple profiles into one profile.

NEW Company Profile Duration Policy (July 2010)

Company profiles will remain on the website for a period of 12 months after expiration of an employer's subscription - at which point the company profile will be removed. An employer may create a new company profile or re-post a previous profile on the website by renewing its subscription.

Job Posting Policy

Only jobs located in Rhode Island may be posted on the website. Job postings for positions outside the state will be removed and the employer will be consulted.

Job postings may contain only one job title per posting.

Employers may post unlimited job postings while their paid subscription remains current and in good standing.

Clarification: Posting Jobs That Do Not Have a Specific Location (July 2010)

Employers are accommodating an increasingly mobile and remote-access workforce and, consequently, are offering jobs that may not be tied to a specific location. To embrace this emerging trend the Company will permit the posting of jobs offered by legitimate employers which are not tied to a specific location, with the following terms and conditions:

  • Employers must continue to meet our requirements for Specific Prohibited Uses.
  • The work for any such job must actually be performed in the state of Rhode Island.
  • The employer must state in the job posting that the job does not have a specific location requirement.
  • The job posting must be tagged as not having a specific location.
  • Examples of such jobs may include, but are not limited to: traveling sales person, account managers, administrative or office support type work that can be performed remotely (e.g. from home) for an employer.
  • As with all postings to the website, the Company reserves the right to remove jobs that do not conform to the requirements and spirit of this policy.

Clarification: Posting Multi-Location Jobs (July 2010)

Employers may create more than one job posting in circumstances where the employer seeks to advertise openings for the same type of position in multiple locations across the state, with the following terms and conditions:

  • Employers must continue to meet our requirements for Specific Prohibited Uses.
  • Employers are reminded that this multi-location provision is not an invitation to create multiple postings for one job in an attempt to artificially amplify a single job opening throughout the website.
  • The work for any such job(s) must actually be performed in the state of Rhode Island.
  • An example of such a circumstance may be, but is not limited to, an employer who seeks to fill similar positions, such as store clerk, in multiple locations across the state.
  • As with all postings to the website, the Company reserves the right to remove jobs that do not conform to the requirements and spirit of this policy.

Clarification: Posting Multi-Position Jobs (July 2010)

  • We recognize that employers may seek to hire more than one person for the same position.
  • For example, an employer may seek to hire more than one lab technician for a newly opened facility.
  • In this circumstance, the employer may create one job posting on the website but may indicate in the job posting that it seeks to fill more than one position.
  • As always - employers must continue to meet our requirements for Specific Prohibited Uses.

Prohibited Uses by Job Seekers

The Company specifically prohibits the use of the website by job seekers for any of the following activities:

  • Registering on the website under false pretenses.
  • Using the website for any activity other than seeking information about employers and job postings on the website or other authorized activities on the website.
  • Registering under false names, pseudonyms, aliases or otherwise misleading personal information.
  • Posting any resume or biographical information that is incomplete, false, inaccurate or misleading.
  • Any action that seeks to gather information about an employer for any purposes other than those stated or inherently implied in the Acceptable Use Policies of the website or for illegal purposes in accordance with applicable state and federal laws.
  • Any action that seeks to harass, annoy or deny service to an employer by means of abusive behavior or use of features on the website for purposes other than that which they are specifically intended.

Additional Prohibited Uses - All Users

  • Deleting or revising any material posted by any other person or entity.
  • Using any device, software or practice to interfere or attempt to interfere with the proper working of the website or any business activity being conducted on the website.
  • Taking any action which imposes an unreasonable or disproportionately large load on this website's infrastructure.
  • Disclosing or sharing your password to the website with other persons or third parties or using your password for any unauthorized purpose.
  • Using or attempting to use any engine, software, tool, agent or other device or mechanism (including, without limitation, browsers, spiders, robots, avatars or intelligent agents) to navigate or search this website other than the search engine and search agents available from the Company on the website and other than generally available third party web browsers, such as Mozilla Firefox, Microsoft Internet Explorer.
  • Attempting to decipher, decompile, disassemble or reverse engineer any of the software comprising any portion of the website in its parts or its entirety.

Career Event Submissions

All career related events will be reviewed and, if accepted, posted to the website within two business days.

The Company reserves the right to review and edit submissions for grammar, style, accuracy and objectionable or conflicting content and reserves the right to refuse any submission at any time for any reason. We may also omit any events that are misleading or advertising company products, services, or job openings.

The Company reserves the right to change any aspect of these guidelines at its discretion, at any time, and will immediately publish changes to the guidelines as soon as they are made.

Examples of acceptable career events include, but are not limited to: job fairs, informational open houses, career development seminars, job training events and networking events. All events must be open to the public and occur within the state of Rhode Island. Events must be submitted at least two weeks prior to start date.

Additional Terms & Conditions

The Company acts only as a medium for the posting and exchange of user-submitted information and expressly disclaims any responsibility for the content of such postings. The Company makes no representations with respect to, nor is it responsible for, the accuracy, completeness, reliability, legality or timeliness of any posting. The Company does not undertake, nor is it responsible for, screening potential or existing users, or reviewing, verifying or censoring postings prior to their posting to the website. Further, the Company does not undertake, nor is it responsible for, screening or monitoring the use of the website by users, or the exchange of information between users, whether conducted through the medium of the website or through other means.

All postings are provided on an as-is basis, and the Company makes no representations or warranties with respect thereto, including, but not limited to, warranties of merchantability or fitness for a particular purpose. Because the Company acts only as a medium for the posting and exchange of information, the Company is not involved in the actual transactions between users. Accordingly, the Company has no control over the veracity, accuracy, safety, legality or other aspects of the postings, nor does it make any representations with respect to the reputation or legitimacy of any user, or with respect to the ability of any user to perform any promises made via the website.

All users should be aware that use of the website, as well as any similar medium, may involve risks to the user, including, but not limited to, risks of physical harm, misrepresentation and fraud. By using the website, users acknowledge the risk of such harm, accept all responsibility therefore, and release the Company from any responsibility or liability with respect to any and all harm or damage they may incur as a result of their use of the website.

Users are encouraged to report to the Company any suspected misuse of the website or violation of this Acceptable Use Policy. The Company may investigate such complaints but shall be under no obligation to do so. The Company reserves the right, in its sole discretion, to remove or refuse any posting, whether as a response to complaints by users or at its own initiative. Further, the Company reserves the right to prohibit use of the website by any user who the Company deems, at its sole discretion, to have misused the website, to have violated this Acceptable Use Policy, or otherwise to have acted illegally, fraudulently, dishonestly or deceptively in its use of the website.

The Company does not warrant that the website will operate without error, or that it will not be used by third parties as a conduit for computer viruses or other harmful mechanisms. If use of the website results in or contributes in any way to harm to a user's computer hardware, software or data, the Company shall not be deemed to be responsible in any way for such harm. In no event shall the Company be liable for any damages, whether direct, indirect, consequential or incidental, related to user's use of the website and user hereby releases the Company from any liability for any such damages.

Violation of the Acceptable Use Policy

Any employer, job seeker or user found in violation of the Company's published Acceptable Use Policy may be removed from the website and denied further access to or use of the website.

Any employer removed from the website for violating the Company's Acceptable Use Policy will forfeit previous payments made to the Company.

Employers may seek to re-subscribe to the website and job seekers may seek re-instatement to the website after demonstrating sufficient remedy of the violation. The Company reserves the right, at its own discretion, to re-instate or continue to deny access to a former user.
